02. Mishpatim 21-01b. the order of the Parsha, an attempt at explaining the sequence of the Halachos, Class Two.
This class begins with a brief review of what we discussed until now.
We added more insight to the idea of כי כספו הוא introducing the radical suggestion that this means the financial portion of the חלק האיסור of the ownership of the slave; and the lack of culpability after 24 hours is because only the financial half of the חלק האיסור remains.
5) We then moved on to people hurting (not killing, nor intending to kill) other people.
If there’s an אסון (someone dies) there’s no financial obligation even of no one is punished for the crime.
If no one dies it is financial and you are culpable even if it was not intentional.
6) If a slave was hurt this way there is the גזירת הכתוב of being freed for losing one of his limb extremities, including eyes or teeth.
7) An animal who kills a person is not obligated to pay.
8) If the animal kills a slave there is a fine of 30 Shekel גזירת הכתוב.
9) Nor is a pit (בור ברשות הרבים) that kills a person liable (שור ולא אדם חמור ולא כלים) this is the continuity, that in both cases one is not liable of his property (ממון המזיק) kills a person.
10) However if (ממון המזיק) kills or hurts another animal (שור or בור) there is financial culpability.
The laws of תם and מועד are touched on.
